Colorado tries to define "person"

Here is an election story we did not discuss in class last week about how Colorado had a ballot issue called Amendment 62 which was trying to define a "person" at the moment of conception. The issue was defeated 71% to 29%, but here is an article discussing the pro's and con's of the the proposed amendment.

  1. Passing an amendment such as that strikes me as incredibly unwise. If a fetus (or a cluster of cells that has not yet grown into a fetus) has due process rights, when would an abortion ever be justifiable? Such an amendment would basically set forth as equivalent the life of the unborn child and the life of the mother. Even if the life of the mother were at stake, that could not justify an abortion (much like we cannot take an essential organ from one living person to save another person's life, if the first person would die). And in cases where the mother does not realize that she is pregnant and accidentally causes a miscarriage -- is that negligent homicide?
